Welcome to Poshfit (“Poshfit,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Poshfit mobile application, website (www.poshfit.ai), and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use Poshfit.


Eligibility

You must be at least 13 years old to use Poshfit. By using the Service, you represent that you are at least 13 and legally capable of entering into this agreement.


Description of Service

Poshfit is an artificial intelligence–powered styling platform that allows users to upload or share images, provide optional information such as style preferences or body measurements, and receive automated outfit recommendations and fashion advice. The Service may include social and chat features that enable interaction among users. Poshfit is provided for entertainment and informational purposes only. Any styling advice, comments, or AI-generated content should not be considered factual, professional, or relied upon for decision-making.


User Content

You may upload or share photos, videos, text, or other materials (“User Content”). You retain ownership of your User Content but grant Poshfit a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, display, modify, reproduce, distribute, and create derivative works from your User Content for operating, improving, and promoting the Service. You are solely responsible for your User Content and for ensuring you have the right to share any material you upload. You agree not to upload or share any content that:

  • Violates any law or regulation;
  • Contains nudity, pornography, sexually explicit material, violence, or hate speech;
  • Infringes intellectual property, privacy, or publicity rights;
  • Contains malware or harmful code; or
  • Violates the acceptable use policies of Poshfit or its third-party technology partners.

Poshfit may remove or restrict access to any User Content that violates these Terms.

 

Use of Artificial Intelligence and Third-Party Services

Poshfit uses third-party artificial intelligence technologies, including but not limited to OpenAI and other providers, to generate style suggestions, chat responses, and related outputs. By using the Service, you agree that:

  • You will not use the Service in any way that could cause Poshfit or its third-party providers to violate their acceptable use, content, or data policies.
  • You will not attempt to manipulate, reverse engineer, or misuse any AI functionality.
  • You will not use the Service to generate or distribute unlawful, harmful, or deceptive content.
  • You understand that AI-generated outputs are automated, may contain errors or biases, and do not represent the views of Poshfit.
  • Poshfit makes no warranties or representations about the accuracy, reliability, or appropriateness of AI-generated content.


User Conduct

You agree not to:

  • Use the Service for any unlawful or prohibited purpose.
  • Harass, impersonate, or abuse other users.
  • Post or transmit content that violates third-party rights or AI provider policies.
  • Interfere with or disrupt the Service or related systems.
  • Use bots, scrapers, or automated systems to access the Service.
  • Circumvent any content moderation or security controls.

Poshfit reserves the right to suspend or terminate your access for any violation of these Terms.



Intellectual Property

Except for User Content, all materials within the Service are owned or licensed by Poshfit and are protected under applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any portion of the Service without written permission.


Disclaimers

The Service is provided “as is” and “as available.” Poshfit disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. Poshfit does not guarantee that AI outputs will be accurate or suitable for any purpose.


Limitation of Liability

To the fullest extent permitted by law, Poshfit and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service or reliance on AI-generated outputs.


Termination

You may discontinue use of the Service at any time. Poshfit may suspend or terminate your account or access at any time, with or without notice, for any reason, including violations of these Terms.


Changes to Terms

Poshfit may update these Terms periodically. Continued use of the Service after updates are posted constitutes your acceptance of the revised Terms.


Governing Law

These Terms and any disputes arising from them are governed by the laws of the State of Delaware, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
